Souter explains the Ryskin v. Banner Health, Inc. decision

Gray Reed's Pat Souter was published in the September 2011 issue of MedStaff News. Pat's discussion explains the Ryskin v. Banner Health, Inc. decision affecting the nexus between Peer Review and Human Resource Issues as they apply to hospital employed physicians.

In July 2010, the U.S. District Court of Colorado passed a ruling that peer review privilege does not apply to documents generated by a hospital's credentialing committee.  According to the court, Colorado state law does not bar physicians from seeking peer review documents when the physician provides sufficient evidence that an employer deviated from the provisions of the professional review and fair hearing plans when terminating staff.
